The Limitation on the Application of Redemption to the Gentry during the Jiaqing Era and Its Background

This study reexamines the background and significance of the regulation enacted in the 20th year of the Jiaqing reign (1815), which restricted the application of redemption for the gentry. Rather than viewing this measure as part of a general contraction of redemption practices, a trend toward harsher punishment, or a simple extension of litigation-suppression policy, this paper situates it within the broader context of the Qing dynasty’s response to the lingering problem of residual elements following the Eight Trigrams uprising of 1813 and its efforts to reorganize the governing system. The regulation stipulated that gentry members engaged in “haosongduoshi(好訟多事) would no longer be permitted to redeem their punishment through payment, but instead be subject to actual penalties. This constituted an exceptional measure that curtailed the legal privileges traditionally enjoyed by the gentry. However, interpreting this policy solely as an attempt to suppress litigation is insufficient. During the Jiaqing period, the Qing state attributed the problem of excessive litigation not to its increase but to administrative disorder, while at the same time the relationship between the state and local elites was becoming increasingly interdependent. This paper argues that the regulation should instead be understood in connection with the prolonged issue of residual rebel groups after the Eight Trigrams uprising. As existing control mechanisms proved inadequate, the Qing court sought to reconfigure local governance by emphasizing the restoration of moral order within society and assigning the gentry a central role in this process. The Juye County incident, in which a licentiate engaged in “contentious litigation,” directly contradicted these expectations, prompting the state to impose institutional constraints on the gentry’s legal privileges. In this sense, the regulation represents a strategic response by Qing state power to a specific crisis, illustrating efforts to utilize and discipline the gentry as intermediaries of governance. Accordingly, the Jiaqing period should be reconsidered not merely as a time of decline, but as one marked by active attempts to reform the governing system in the face of crisis. |
